This document forms part of the RHIXO controlled legal framework and applies as described below. It operates together with the RHIXO Customer Agreement, RHIXO Product and Service Schedule, accepted order and other incorporated documents where relevant.
1. Acceptance and scope
By accessing or using the Website, you agree to these Terms. If you use the Website for an organisation, you represent that you have authority to bind that organisation. Product purchases, subscriptions, hosting and other paid services are also governed by the applicable Customer Agreement, Product Schedule, order terms and policies presented at purchase.
2. Permitted use
You may use the Website for lawful business or personal purposes, including reviewing products and pricing, creating an account, submitting enquiries, accessing support and using publicly available resources.
3. Prohibited conduct
- attempting unauthorised access to accounts, systems, networks, data or administrative functions;
- circumventing security, rate limits, access controls, robots exclusions or technical restrictions;
- introducing malware, destructive code or automated traffic that materially degrades service;
- scraping, harvesting or bulk extracting content or data except where expressly authorised or permitted by law;
- impersonating another person or entity, submitting false information, or using the Website for fraud or unlawful conduct;
- infringing intellectual property, privacy, confidentiality or other legal rights;
- interfering with another user or with the integrity, availability or security of the Website.
We may restrict, suspend, block or investigate activity reasonably believed to threaten the Website, users, third parties or our legal obligations.
4. Accounts and credentials
Where the Website provides account access, you are responsible for safeguarding credentials, using reasonable security controls and promptly notifying us of suspected compromise. Activity conducted through your authorised account may be treated as activity authorised by you unless the circumstances reasonably indicate otherwise.
5. Website content and changes
We take reasonable steps to keep published information current, but Website content is general information and may change. Product descriptions, screenshots and demonstrations may depict features that differ by plan, region, release or configuration. A specific order or Product Schedule prevails over general marketing material where they conflict.
6. Intellectual property and trade marks
Unless expressly stated otherwise, the Website, software, branding, text, graphics, interface elements, media and other materials are owned by or licensed to the applicable rights holder. No ownership transfers to you. You receive only the limited right to access and use the Website for its intended purpose. Trade marks and brand assets remain subject to the applicable InnovatechIQ brand and trade mark rules.
7. User submissions and feedback
You must have the rights and authority necessary to submit material through the Website. You grant the Service Provider a non-exclusive licence to host, process, transmit and use submitted material only as reasonably necessary to provide the requested service, operate the Website, comply with law and protect the platform. Feedback and suggestions may be used to improve products without payment unless otherwise agreed in writing.
8. Third-party links and services
Third-party websites and services are governed by their own terms and privacy practices. We do not control them. Where a third-party service is integral to a purchased product, responsibilities and dependencies may be further described in the applicable Product Schedule.
9. Availability and security
The Website may be changed, suspended or unavailable for maintenance, security, operational or third-party reasons. We do not promise uninterrupted or error-free availability. Nothing in this clause limits rights that cannot lawfully be excluded.
10. Privacy and cookies
Personal information is handled in accordance with the Privacy Policy published at https://rhixo.com.au/privacy. Cookie and similar technology practices are described at https://rhixo.com.au/cookies.
11. Disclaimers
To the maximum extent permitted by law, the Website is provided on an "as available" basis. General Website information is not legal, tax, accounting, safety, engineering or other professional advice. You remain responsible for decisions made in reliance on general information.
12. Liability and non-excludable rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded. Subject to those rights, neither party is liable for indirect or consequential loss arising solely from use of the public Website where such loss is not reasonably attributable to that party's breach, negligence, wilful misconduct or other liability that cannot lawfully be limited.
13. Suspension and termination of access
We may suspend or terminate Website access where reasonably necessary to protect security, comply with law, address misuse or enforce these Terms. Suspension of public Website access does not by itself terminate a paid customer agreement unless the applicable customer terms provide otherwise.
14. Changes to these Terms
We may update these Terms. The current version and effective date will be published with the Terms. Material changes affecting an existing paid customer relationship are governed by the applicable Customer Agreement and Product Schedule.
15. Governing law and disputes
Unless the applicable Product Schedule or order identifies a different contracting jurisdiction, these Terms are governed by the laws of Queensland, Australia. Mandatory laws and non-excludable rights continue to apply.
16. Complaints and contact
Complaints and legal enquiries should be lodged through the Support Service by emailing team@rhixo.com.au. A ticket reference will be created and used to manage the matter.
